«28 Day Sobriety Challenge» CONTEST
1. CONTEST DURATION
« 28 Day Sobriety Challenge » Contest (the « Contest ») is organized by the Fondation Jean Lapointe, (the « Organizer ») and starts February 1st 2017 00:00 (Eastern Daylight Time) and ends February 28th 2017 23:59 (Eastern Daylight Time).
The Contest is open to legal residents who have reached the legal age of majority in their respective country at the Contest opening date. Employees of Fondation Jean Lapointe, their respective affiliates, subsidiaries, advertising and promotion agencies, suppliers and their immediate family members and/or those living in the same household of each are not eligible to participate in the Contest. For the purpose of these Contest rules, “immediate family” means husband, wife, spouse, common law spouse, mother, father, grandmother, grandfather, brother, sister, son and/or daughter, whether or not they reside in the same household.
3. HOW TO PARTICIPATE
To participate, the participant must visit the Internet site https://www.defi28jours.com (the « Contest Web site»)and complete the official online entry form, donate at least 28 dollars to the Fondation Jean Lapointe and fulfill all Contest requirements, as specified, to be eligible to win a prize. All data fields on the entry form must be completed, unless it is indicated that the information is optional. Only Contest participants are entitled to prizes, if they indicate they have not consumed alcohol during a given period. A participant in the Contest may submit only one (1) entry form during the Contest period. A participant in the Contest can only use one (1) email address (which must be valid) to register on the Contest Web site. One (1) participant per entry form. One (1) email address cannot be used by more than one (1) participant. The Organizer reserves the right to disqualify any person who violates or attempts to violate the Contest rules.
Draws will be held throughout the Contest period, at Fondation Jean Lapointe offices located at 123, St-Pierre Street, Montreal (Quebec) H2Y 2L6. One (1) entry form will be drawn at random from all eligible entries received. The selected potential winner will be notified by telephone and email. Before being declared a winner, the selected potential winner must correctly answer a mathematical skill-testing question to be administered by email: answer must be provided without assistance of any kind, whether mechanical or otherwise. In the event that the selected potential winner does not respond to the email from the Organizer’s representative within four (4) working days of the draw, he/she will be disqualified and will not receive the prize and another potential winner will be selected among all remaining eligible participants. In the event the representative of the Organizer is unable to notify a selected potential winner within a reasonable time or if he/she does not respond to the email from the representative of the Organizer within four (4) working days, the selected potential winner will be disqualified and the Organizer has the right, at its sole discretion, to cancel the award.
5. PRIVACY / USE OF PERSONAL INFORMATION
By participating in the Contest, participants consent to the collection, use and disclosure of personal information by the Organizer or its authorized agents for the purpose of administering the Contest and awarding the prizes. By accepting a prize, winners consent to any use of their name, address (city, province), voice, statements, picture, photographs or other likenesses and recordings for publicity purposes in all media and formats, including, without limitation, to the Internet, without further notice or compensation, and any winner may be required to sign a document to that effect.
Entry forms containing or presenting errors will be canceled. The entry forms that have been tampered with, mutilated, altered, forged, reproduced or obtained illegally will not be eligible. Without limiting the scope of the exemption provided for in Article 5, it is understood that the beneficiaries of the exemption contained in the release form will not be liable for: a) any incomplete or inaccurate information, whether caused by Contest Web site or equipment or program used in the Contest or by any technical or human error which may occur in the processing of the entry form; b) the theft, destruction or unauthorized access to or alteration of newsletters thereof; c) technical difficulties or problems experienced with any telephone network or lines, computer online systems, servers or providers, computer equipment and software, viruses or bugs; d) the inability of the Organizer, for any reason, including congestion on the Internet or on a website, or both, to receive or send e-mail; e) damage to the computer system or device of the participant or of another person due to the participation or downloading of materials from this Contest.
7. RIGHT TO CANCEL, AMEND, MODIFY OR TERMINATE
By entering this Contest, each participant agrees to be bound by these rules which are available on the Contest Web site throughout the Contest period.
The Organizer reserves the right, in their sole discretion, to change or cancel without notice the Contest rules, subject to obtaining any necessary approval from the Régie des alcools, des courses et des jeux. Subject to the foregoing, the Organizer can make any change at any time or terminate the Contest in whole or in part if, at its sole discretion, if the Organizer determines that for any reason, the Contest is not proceeding as planned, including by reason of tampering, destruction, loss or theft of entries or any other defect that might compromise the fairness or integrity of the Contest.
By participating in this Contest or trying to participate, each participant or presumed participant agrees to release, discharge and hold harmless forever, the Organizer and its directors, officers, employees, shareholders, agents or other representatives, its parent companies and its affiliates from any claims, actions, damages, demands, manner of actions, causes of action, suits or liabilities of any nature whatsoever arising from or related to participation in the Contest or attempted participation in the Contest, compliance or not to the Contest rules or the acceptance and use of the prize.
Participants who do not comply with these official rules are subject to disqualification from this Contest and any other future Contest or promotion held by the Organizer. Official Contest rules are available on the Web site at the following address https://www.defi28jours.com. All decisions of the Organizer and of the body responsible for judging the Contest are final and binding with respect to all aspects of the Contest. The Contest is subject to all applicable federal, provincial and municipal laws. No prize is transferable. Prizes must be accepted as awarded with no substitutions in cash or otherwise, except at the sole discretion of the Organizer.
The Organizer reserves its right to substitute a prize of equal value in replacement of a prize that cannot be awarded as provided herein. The Organizer and the other releases will not be responsible for illegible, incomplete, mutilated, lost, routed to the wrong address or late bulletins which will be void. The use of automated systems is prohibited. Only selected participants will be contacted. No prize will be awarded if the winner has not been confirmed. In the event of a dispute over who submitted an online entry, it will be deemed submitted by the authorized account holder of the email address submitted at the time of validation of the entry form. “Authorized account holder” is defined as the natural person who is assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the email address in question. A selected participant may be required to provide proof to the Organizer that he or she is the authorized account holder of the email address associated with the selected participant.
The Organizer reserves its right, at its sole discretion to disqualify, from this Contest and any other Contest or any future promotion held by the Organizer, anyone guilty or suspected of having tampered with the processing of ballots or the operation of the Contest or the Contest Web site, to have violated the official rules or acting in an unsportsmanlike or disruptive manner or with intent to annoy, abuse, harass, threaten any other person. ANY PARTICIPANT OR ANY OTHER PERSON WHO DELIBERATELY ATTEMPTS TO DAMAGE THE FACEBOOK PAGE AND CHALLENGE WEBSITE OR ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS COMMITTING AN ILLEGAL ACT AND THE ORGANIZER RESERVES, IN SUCH CASES, THE RIGHT TO SEEK REMEDIES AND DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW INCLUDING BUT NOT LIMITED TO CRIMINAL PROSECUTION.
9. RÉGIE DES ALCOOLS, DES COURSES ET DES JEUX
The Régie des alcools, des courses et des jeux du Québec is not related in any way to this Contest and shall not be liable in any way whatsoever for any matter relating to this Contest.
Any litigation in regards to the conduct or organization of a publicity Contest may be submitted to the Régie des alcools et des jeux du Québec for a ruling. Any litigation regarding the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement. People who participate in the Contest acknowledge having read these rules and agree to comply.
